DEFINITIONS
“Under cover” is an outdoor area that is covered by a roof structure which offers increased protection to the item
“Exposed” is an outdoor area where no roof structure is protecting the item
“Normal Outdoor use” means the item will be situated in an outdoor position either under cover or exposed to nominal daily and seasonal weather and as such will perform for the full warranty period. after this maintenance is expected and will be required.
SAFETY, CARE AND MAINTENANCE
Brisbane Lawn chairs are very solid and weigh approximately 30Kg. You should never attempt to pick up the chair and carry it on your own, always ask someone to help carry the chair. Performance of the chairs can only be sustained from year to year if the paint system is kept intact and clean from organic material like tree fall and droppings, spillage, corrosive chemicals like chlorine, bromine, spirits, liquid fuels and bleach.
All timber outdoor furniture can expect to deteriorate if constantly exposed to Full Sun (UV), high temperatures (like fireplaces and barbecues ) and constant flooding or immersion with water other than nominal rainfall.
It is reasonable to expect that one year to the next a lack of cleaning, maintenance and protection against these element will affect the performance of the materials and workmanship of the item supplied.
In most situations using a soft brush and mild soapy water followed by a rinse with the hose is the recommended method for cleaning. The use of a high pressure washer could damage the paint system so is not advised
FORCE MAJEURE
Neither party will be liable for failing to perform its obligations under this sale as long as the failure is triggered by something beyond its reasonable control.
A natural disaster like but not exclusively flood, cyclone or hurricane, severe thunderstorm and hail.
It is reasonable to expect that the buyer will heed all advice issued by local authorities to secure or place under cover outdoor items during weather events.
This clause does not excuse payment of monies due. Ownership of the items does not pass to the buyer until the items are paid for in full.
- REFUNDS OR RETURNS
We are not required to provide a refund or replacement if you change your mind, given that all chairs are delivered in person and signed for as inspected against what was advertised
But you can choose a refund or exchange if an item has a major problem.This is when the item:
● has a problem that would have stopped you from buying the item if you had known about it
● is unsafe
● doesn’t do what we said it would, or what you asked for and can’t be easily fixed.
Alternatively, you can choose to keep the item and we will compensate you for any drop in value. If the problem is not major, we will repair the item within a reasonable time. If it is not repaired in a reasonable time you can choose a refund or replacement. Please keep your proof of purchase—e.g. your receipt.
MANUFACTURERS WARRANTY
The furniture will be free from defects in workmanship, materials and construction for one year from the date of purchase. But we are keen to ensure that our chairs last for many years so are happy to provide a limited warranty for additional 2 years on inspection.
In the event that a defect is found, the manufacturer will either repair or replace the defective item, at its discretion.
Some performance aspects are simply out of any manufacturer’s control. So while a warranty for problems under “normal outdoor use”, it includes specific limitations.
Warranties may not apply to:
Defects that result from negligence, misuse, or accidents.
Any condition resulting from incorrect or inadequate transport , handling, maintenance, cleaning or care and or commercial use.
Any condition resulting from other than ordinary residential wear or from any use for which the product was not designed.
Our chairs are designed to perform in the role of a solid lounge chair for outdoor use. They are not designed to be dragged frequently across hard surfaces
